The Data Protection Commission (DPC) has published a comprehensive report on its Regulatory Activities for the two-year period to 25 May 2020 which includes details on its activities in respect of supervision and enforcement activities. Of particular note are the following items highlighted therein: –

• DSARS; fair processing; disclosure; right to be forgotten (delisting and/or removal requests); direct marketing and data security remain the most common areas for complaints and queries to the DPC;
• 80% of the 12,437 breaches reported to the DPC during the period related to unauthorised disclosure; ​
• The DPC considers that data controllers need to introduce more robust technical and organisational measures and processes for testing, assessing and evaluating these measures the data protection officer going forward;
• the DPC continues to see high volumes of cases that could be resolved at DPO or controller level;
• the DPC has found that in many instances DPO’s require further supports; and
• Following It’s publication of a report and guidance in relation to the use of cookies in April of this year, the DPC intends to commence enforcement actions against controllers who fail to comply with same after 5 October 2020.
